These Terms of Service ("Terms") govern your use of the website florithm.com and the mobile applications published by Florithm LLC ("Florithm", "we", "us", or "our"). By accessing or using our website or apps, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using any Florithm application or visiting florithm.com, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use our services.

2. Description of Services

Florithm LLC develops and publishes iOS mobile applications available on the Apple App Store, including but not limited to: My Color Palette, Profile Picture Maker, Countdowns, TapTapTask, RightRead, Phonics Cards, Fish or Bait, and Fleet Keeper+. Our website provides information about these applications and a means to contact us.

3. Eligibility

Our apps have no general age restriction. Age ratings for each individual app are determined by content and are listed on their respective App Store pages. Please refer to each app's page for specific age guidance.

4. App Store Terms

Our iOS applications are distributed through the Apple App Store. Your download and use of these apps is also subject to Apple's Terms and Conditions and Media Services Terms of Service. In the event of any conflict between these Terms and Apple's terms, Apple's terms shall govern with respect to your use of the App Store.

5. Intellectual Property

All content on florithm.com and within our applications — including text, graphics, logos, icons, images, app designs, and software — is the property of Florithm LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. User Conduct

When using our apps or website, you agree not to:

  • Use the services for any unlawful purpose or in violation of any applicable laws
  • Attempt to reverse-engineer, decompile, or disassemble any part of our applications
  • Interfere with or disrupt the integrity or performance of the services
  • Upload or transmit any malicious code, viruses, or harmful content
  • Impersonate any person or entity or misrepresent your affiliation with any entity

7. In-App Purchases

Some of our applications offer optional in-app purchases processed through Apple's App Store. All transactions are subject to Apple's payment terms. Florithm LLC does not collect or store your payment information. All purchases are final and non-refundable except as required by applicable law or Apple's refund policy.

8. Privacy

Your use of our services is also governed by our Privacy Policies, which are available on each app's detail page. By using our services, you consent to the practices described in the applicable privacy policy.

9. Disclaimer of Warranties

Our apps and website are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the services will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Florithm LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, or business interruption — arising from your use of or inability to use our services, even if we have been advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or your use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Changes to Terms

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of our services after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

12. Termination

We reserve the right to suspend or terminate your access to our services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
